These Terms of Service (“Terms”) govern your access to and use of the YAYYAK website and related services (the “Service”). YAYYAK is an online platform that assists users, including foreign customers, in reserving skincare, beauty, and cosmetic services provided by independent third-party service providers located in the Republic of Korea (“Korea”).
By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations of Korea. If you do not agree to these Terms, you must not use the Service.
These Terms are written in English and apply to all users regardless of their location or nationality. By using the Service, you agree to be bound by the English version of these Terms. If translations of these Terms are provided, they are for convenience only, and the English version shall prevail in the event of any inconsistency.
1. Description of Services
1.1. YAYYAK operates an online reservation and communication platform that connects users with independent third-party skincare, beauty, and cosmetic service providers in Korea.
1.2. YAYYAK does not provide medical, dermatological, cosmetic, or healthcare services and does not offer medical advice, diagnosis, or treatment.
1.3. All services displayed or reserved through the Service are provided solely by third-party service providers, who operate independently and are not employees, agents, partners, or representatives of YAYYAK.
2. Eligibility
2.1. You must be at least eighteen (18) years old to use the Service.
2.2. To use certain features of the Service, including making reservations, users must register for an account using a valid personal email address.
2.3. By registering an account, you represent and warrant that the information provided is accurate, complete, and lawfully obtained.
2.4. You represent and warrant that you have the legal capacity to enter into these Terms and that your use of the Service complies with all applicable laws.
3. User Responsibilities
3.1. Users agree to:

Provide accurate and truthful information when submitting reservations or inquiries;

Use the Service only for lawful purposes;

Refrain from any activity that disrupts or interferes with the Service.
3.2. Users represent that they have the legal right to provide any information submitted through the Service.
3.3. YAYYAK is not responsible for any loss, delay, or disadvantage resulting from inaccurate, incomplete, or false information provided by users.
4. Reservations and Third-Party Services
4.1. All reservations made through the Service are requests to third-party service providers. Acceptance, modification, or rejection of a reservation is at the sole discretion of the service provider.
4.2. YAYYAK acts solely as an intermediary and platform operator and is not a party to any agreement between users and service providers.
4.3. To the maximum extent permitted by law, YAYYAK:

Does not guarantee the availability, quality, safety, legality, or suitability of any third-party services;

Does not verify the qualifications, licenses, or regulatory compliance of service providers.
4.4. Any dispute, claim, or issue related to third-party services must be resolved directly between the user and the service provider.
5. Fees, Payments, and Cancellation Policy
5.1. Reservation Fee

YAYYAK charges a reservation fee of KRW 50,000 per person for each reservation made through the Service.

Where payment is processed in a currency other than Korean Won (KRW), the final amount charged to the user may vary due to exchange rates, payment processing fees, and the policies of the payment provider (including, but not limited to, PayPal or the user’s bank or card issuer).

The reservation fee is applied as a deposit and deducted from the total treatment fee charged by clinics at the time services are rendered.

The user acknowledges and agrees that YAYYAK does not control and is not responsible for any such differences in the final amount charged.
5.2. The reservation fee is collected by YAYYAK for facilitating reservations and communication.
5.3. Cancellation and Refund Policy

Cancellations made at least seven (7) days prior to the reservation date are eligible for a full refund or a one-time rescheduling.

Cancellations made within seven (7) days of the reservation date are non-refundable.

Failure to attend a scheduled reservation without prior notice (“no-show”) is non-refundable and not eligible for rescheduling.

Exceptions may be granted in cases of unavoidable circumstances, such as medical emergencies or flight cancellations, provided that reasonable supporting documentation is submitted.

All such exception requests are subject to review and approval at the sole discretion of the company.
5.4. All remaining payments, including treatment fees and additional charges, are made directly between users and third-party service providers and are subject to the provider’s own policies.
5.5. YAYYAK is not responsible for disputes, chargebacks, refunds, or claims related to payments made to third-party service providers.
5.6. Promotional Benefits

YAYYAK may, at its discretion, offer promotional incentives to users.

For example, an Olive Young ₩10,000 gift card may be provided upon completion of a post-treatment survey, provided that all applicable promotional conditions are met.

Such promotions are subject to specific conditions and may be modified or discontinued at any time without prior notice.
6. User Rights and How to Exercise Them
6.1. YAYYAK does not provide, control, supervise, or guarantee any treatment, procedure, consultation, or service provided by third-party clinics or service providers.
6.2. YAYYAK shall have no responsibility or liability for any event, injury, loss, damage, dissatisfaction, complication, side effect, medical issue, or outcome that occurs during or after any treatment or service provided by a third-party service provider.
6.3. YAYYAK shall also have no responsibility or liability for any payments, fees, refunds, cancellations, pricing disputes, or financial arrangements between users and third-party service providers, whether occurring before, during, or after services are provided.
7. Personal Information and Privacy
7.1. YAYYAK collects personal information necessary to provide the Service, including name, email address, contact details, and reservation information.
7.2. Personal information is collected and processed in accordance with the Personal Information Protection Act of Korea and other applicable laws.
7.3. Details regarding data processing are set forth in the Privacy Policy, which forms an integral part of these Terms.
8. Intellectual Property
8.1. All content provided through the Service is owned by or licensed to YAYYAK and protected by applicable intellectual property laws.
8.2. Users may not reproduce, distribute, or use any content without prior written consent, except as permitted by law.
9. Limitation of Liability
9.1. To the maximum extent permitted by applicable law, YAYYAK shall not be liable for:

Any indirect, incidental, or consequential damages;

Any loss or damage arising from third-party services;

Any injury, claim, dispute, or loss related to treatments or payments involving third-party service providers;

Errors, interruptions, or delays in the Service.
9.2. Nothing in these Terms limits liability that cannot be excluded under Korean law, including liability for willful misconduct or gross negligence.
10. Termination
10.1. YAYYAK may suspend or terminate access to the Service if a user violates these Terms or if required by law.
10.2. Where reasonably practicable, prior notice will be provided.
11. Changes to the Terms
11.1. YAYYAK may modify these Terms to reflect changes in law or the Service.
11.2. Material changes will be notified at least thirty (30) days in advance.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Korea. All disputes shall be subject to the exclusive jurisdiction of the courts of Korea.
